Terms and Conditions of Use

Thank you for visiting the Sacramento County Employees’ Retirement System (SCERS) website at scers.gov, related SCERS websites or affiliated mobile applications (collectively, the “Site”). Your use of the Site, its content, services or functionality, including, but not limited to, any information, photographs, maps, tools, customer communications, project bidding, links to third party websites, downloadable content, or promotional material (collectively, the “Services”), is governed by these Terms and Conditions of Use (the “Terms”), and to the extent applicable, the current version of SCERS’ Privacy Guidelines. By using the Site and its content, you agree to be bound by these Terms.

SCERS reserves the right to change these Terms without prior notice. It is your responsibility to regularly review the Terms for any changes. The Terms are available and accessible online from the link included on each page of the Site. Use of the Services following any change to the Terms will be deemed an acceptance of such Terms. Any such changes, modifications or alterations to these Terms may affect your use of the Site without any liability or responsibility of SCERS.

The rights and obligations of SCERS and its members, retirees, and beneficiaries are governed by the California County Employees’ Retirement Law of 1937 and various federal, state, and local laws, rules and regulations which are complex and subject to change. In the event of any conflict between those governing authorities and the information contained on the Site, the governing authorities will prevail.

Permitted Use:

The rights granted to you under these Terms are limited to accessing and displaying or otherwise utilizing the Site and Services. The Site and Services are available as a resource for your personal, non-commercial use, not intended for or directed towards commercial advantage or monetary compensation, and may not be used as a part of any advertisement, promotion or other commercial endeavor. You shall not change, tamper, dismantle, augment, misrepresent, modify, reproduce, redistribute, or frame any of the content contained on the Site, or received via the use of the Services, without the advance, written consent of SCERS and any relevant third party affiliates; provided, however, that you may print and download portions of material from the different areas of the Site solely for your own non-commercial use if you agree not to change or delete any trademark, copyright or proprietary notices from the materials. You shall not use the Site and/or Services in any way that causes detriment or disruption to the Site or SCERS.  You agree to comply with all applicable laws and regulatory requirements in relation to your receipt and use of the Site and Services. You shall not have any rights to assign, transfer or convey this agreement to any third party. Users of the Site and Services agree to release and hold SCERS, its trustees, employees, agents, and representatives harmless from any and all claims, demands, and/or causes of action arising out of or related to the use of the Site and Services.

Member Use:

If you are a SCERS member and have created an account with SCERS to use the MySCERS Member Portal services and website, you will be required to: (1) enter a username and password each time you want to access and use the Site; and (2) agree to the Terms and Conditions of Use therefor.

Intellectual Property:

The Site and Services include many materials that are provided and made available for public access.  However, the Site and Services also include images, a benefits calculator, the member portal, and the SCERS Tree logo, along with other marks used by SCERS that are trademarks of SCERS (collectively, with any future trademarks used or registered by SCERS, the “SCERS Marks”), that are all protected by intellectual property laws and may be owned by SCERS or its content suppliers and/or licensors.  Subject to these terms, all rights to the SCERS Marks are reserved.

You may download and copy any material on our Site or Services only for: (1) personal, non-commercial home use; or (2) for educational purposes.

You have no right to copy, reproduce, republish, upload, download, post, transmit, or distribute anything from our Site or Services for profit-making activities.

Software:

SCERS makes certain software products (“Software”) available via the Site and/or the Services including, without limitation, the Benefits Calculator. Although you may use the Software, you may not reproduce or redistribute it.

Links To Other Websites:

Some links on the Site take you to other websites. These other websites may not be under the control of SCERS, and SCERS is not responsible for their content, policies or security. SCERS is providing these links as a convenience, and in doing so does not imply support or endorsement of any kind.

No Automated Queries:

You shall not send scripted, automated or otherwise programmed queries of any sort to the Site without express written permission in advance from SCERS.

Termination:

SCERS shall have the right in its sole discretion to terminate your use of the Site and Services if you are found to have used the Site and/or Services in a manner inconsistent with these Terms. In addition, SCERS may change, suspend or discontinue all or any aspects of the Site or Services, including availability, at any time, and may suspend or terminate your use at any time and for any reason. SCERS reserves the right to make changes to these Terms at any time.

Privacy:

SCERS’s Privacy Guidelines will apply to all personally identifiable information collected in connection with your use of the Site or the Services, including any mobile or digital application. SCERS’s Privacy Guidelines can be found and accessed from any page of the Site. 

Applicable Law:

The Site and Services are created, controlled, and provided by SCERS in Sacramento County, California. As such, the laws of the State of California will govern these Terms, without giving effect to any conflict of law principles. In any dispute, venue and jurisdiction shall reside in Sacramento County, California.

Miscellaneous:

Failure by SCERS to insist upon strict performance of any part of these Terms, or delay in or failure to exercise any rights or remedies to which it is entitled, shall not constitute a waiver of such right or remedies, nor shall termination of these Terms by SCERS operate as a waiver of any of these Terms.  Any express waiver of any breach of these Terms by SCERS does not constitute a waiver of any subsequent breach of these Terms.  Waivers shall only be valid if recorded in writing and signed by SCERS.

If any provision of these Terms is held invalid, illegal or unenforceable for any reason by a court of competent jurisdiction, such provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect as if these Terms did not include the invalid, illegal or unenforceable provision.

Entire Agreement:

These Terms, and all documents and materials referred to herein, constitute the entire agreement between you and SCERS governing your use of the Site and Services, and supersede any prior agreements or understandings between you and SCERS related thereto.
